This decision aside, they historically have some of the most baffling interpretations of law ever seen in courtrooms, hence the shitty (and deserved) reputation. The appeals court ruling will stand if there is a tie in the supreme court. If I were the Trump administration, I would hold off on appealing to the SCOTUS until Gorsuch is seated. Then move forward when there is at least no chance of a tie. Thank goodness I'm not a part of this administration. I'm probably not a reasonable person in the world of what actions presidents should take etc. In the end, with a complete SCOTUS he wins the case. He may win it with the split court, so there's no telling in all honesty. Either way, unreasonable people like me will be left with this horrible taste in our mouth about his rhetoric leading up to this eventual order. Side Note: From 1999-2008 the Ninth Circuit heard a total of 114,199 cases and of that number 175 were heard by the high court. 107 reversed, 33 vacated and 35 affirmed. The Ninth Circuit heard almost 40,000 more cases than the next closest circuit, being the Fifth Circuit during that same time frame.
