NEW YORK (AP) — New York’s highest court rejected former President Donald Trump’s last-ditch effort to avoid testifying in the state attorney general’s civil investigation into his business practices on Tuesday, clearing the way for his deposition next month.

The state’s Court of Appeals said there was no “substantial constitutional question” that would warrant its intervention in the matter following an intermediate appellate court’s ruling last month enforcing a subpoena for Trump’s testimony.

The court also dismissed a motion by Trump’s lawyers to stay the subpoenas, saying that doing so would be “academic,” since it wasn’t taking up the former president’s appeal in the first place.

Trump and his two eldest children, Ivanka and Donald Trump Jr., agreed last week to answer questions under oath starting July 15 unless the Court of Appeals decided to step in.

 

A messages seeking comment on Tuesday’s ruling was sent to Trump’s lawyer. Alan Futerfas, a lawyer for Ivanka and Donald Trump Jr., declined comment. A message was also left with a spokesperson for Attorney General Letitia James.

The appellate division of the state’s trial court ruled May 26 that the Trumps had to undergo a deposition, upholding a lower court’s ruling that James’ office had “the clear right” to question Trump and certain other figures in his company, the Trump Organization.

James has said her three-year investigation has uncovered evidence that the Trump Organization exaggerated the value of assets including skyscrapers, golf courses and even his Manhattan penthouse to get loans, insurance and tax breaks for land donations.

A lawyer for her office told a judge last month that evidence could support legal action against the former president, his company or both, though the attorney said no decision had been made.

Trump has decried the investigation as part of a politically motivated “witch hunt” against him.

Rick Maddow deserves credit for stating an obvious truth coming to light well after the fact rather than knee-jerk reactions from the time of the event.

It's a historically blue district, over 80% Hispanic and Joey Applesauce won it by over 5 points.

 

Well, Republican Mayra Flores just dusted her Democrat challenger by nearly 8 points. 😁

Donald Trump Jr. is offering his father's supporters a chance to sign the former president's "official" birthday card — but only if they donate money to his fundraising committee.

"My father has done so much for this great Country, and I know it would mean so much to him to see YOUR NAME on his OFFICIAL Birthday Card," Trump Jr. wrote in an email received by Insider on Tuesday night.

A link in the email allows the recipient to write a message to the former president, but potential well-wishers must first pledge at least $1 to send in their online birthday greeting.

Donald Trump Sr. was born on June 14, 1946. Despite the email being sent on the same date this year, the WinRed fundraising website says it allows contributors to get "EARLY ACCESS to leave [Trump Sr.] a special birthday message before ANYONE ELSE."

"This is President Trump's ONLY Official Birthday Card," Trump Jr. wrote in his email. "So make sure you sign THIS ONE and not the other fake ones out there."

"HURRY — there's not much time left. I can only save your spot for 20 MINUTES," the email continues.

The former president's fundraising efforts have come under renewed scrutiny after the January 6 House Committee suggested he had raised millions on false claims that the presidency was stolen from him.

According to campaign filings, Trump Sr. raised more than $250 million in the two months after the 2020 election — during which he aggressively touted his baseless claims of voter fraud.

The New York Times reported that Trump has since accumulated a total of $390 million in donations, which he said would help to overturn his election defeat, boost his allies' political campaigns, and "save America from Joe Biden and the radical left."

However, the outlet reported that much of the money has actually gone to paying off expenses for Trump's 2020 presidential campaign and strengthening his political operation so he can run for president again in 2024. Per The Times, he still has $144 million of these contributions in the bank "as of a few months ago."

According to the January 6 committee, the Trump team would send up to 25 fundraising emails a day before the Capitol attack. Both Trumps would often send donation requests from the same email address, touting rewards such as a signed photo from the former president and a chance to win an "exclusive VIP" dinner with Trump.

New York Attorney General Letitia James will investigate possible fraud surrounding some $250 million in campaign donations Donald Trump raised in the months after the 2020 presidential election through his "Big Lie" claims, a source has told Insider.

James, who is already probing the former president's hotel and golf resort empire, can claim jurisdiction on behalf of defrauded New York donors, the source, who is familiar with the AG's plans, said Tuesday night.

The source requested anonymity because they were not authorized to speak on the record about James' plans to look at possible fraud connected to Trump's post-election fundraising.

In addition to citing a duty to New York donors, the AG can also use New York City's banking industry to establish jurisdiction, one former assistant attorney general said.

"If the money passed through any institution with a foot in New York, that gives her jurisdiction," said Tristan Snell, who was the lead assistant in the AG office's 2014 prosecution of Trump University.

James had signaled in a Monday night tweet that she found details revealed earlier in the day — during the second televised Congressional hearing on the January 6, 2021 attack on the Capitol — "disturbing."

The tweet did not specify what James found to be disturbing. But testimony during the hearing revealed that Kimberly Guilfoyle, Donald Trump Jr.'s fiancée, had been paid $60,000 by Trump's "official election defense fund" for a brief speech she made during his January 6 "Stop the Steal" rally.

Financial disclosures have shown that Trump raised more than $250 million off of his "stolen election" claims in the two months after Election Day.

"It's my duty to investigate allegations of fraud or potential misconduct in New York," James had said in her tweet, again without detail. "This incident is no exception," she tweeted.

Snell predicted that a campaign-fraud probe would have much smoother sailing compared to the AG's probe into the Trump Organization, which has dragged on for three years, in large part due to extended battles by Trump lawyers over James' subpoenas for evidence and testimony.

Also on Tuesday night, James notched her latest hard-won battle on that legal score. New York's highest court rejected a last-ditch attempt by Donald Trump, Ivanka Trump, and Donald Trump, Jr., to dodge James' subpoena for his testimony.

"In this particular case, investigators are going to be able to get what they need without going through Trump himself," Snell told Insider.

"It's not the kind of thing that will require internal Trump business documents," which is where investigations slow down, he noted.

Banks routinely respond seamlessly with AG subpoenas, he said.

"There's no bank that's not going to comply with a subpoena from the New York AG's office," unless the bank itself is under investigation, explained Snell, who subpoenaed banks for the Trump University probe and others.

Also, "There were mass solicitations," added Snell, founder of MainStreet.com and a legal commentator on CNN and MSNBC.

"So it's not like they're not going to get what was said in emails to donors — saying, 'Your money is going to go to X.' And then if it didn't, then that's fraud."

SAN FRANCISCO, CA—Mayor London Breed held a press briefing Tuesday in which she happily reported there was now less poop on the street as a result of ongoing food shortages.

"Since no one has any food to eat, no one is pooping!" said Breed. "Problem solved! I'm doing a good job!" 

Breed was joined at the briefing by a representative from the city's Sanitation and Streets Department who appeared uncomfortable with the idea of public speaking and chimed in with pre-prepared quotes from Tony Bennett songs.

"The loveliness of Paris seems somehow sadly grey now that there's no excrement to see on Don Chee Way," said Sanitation Coordinator Randy Pailton. "So, uh, no need to leave your heart here. Why not stay?"

Mayor Breed ended the briefing with a hopeful message for the city's future.

"People of San Francisco, they said it could not be done but we have proven them wrong!" she said to massive applause. "If this food shortage keeps up we'll be able to wipe out poop once and for all!"

"That's why I'm introducing common-sense measures to further cut food supplies within our fair city. We've got to be less tolerant of all the poop that has destroyed our city!”

According to sources, city excrement is down over 35%. The strain on the sewage system is also diminished. 

At publishing time, city officials did remind everyone to continue avoiding Castro Street for sanitation purposes.

In the interest of national security I think we need to mobilize all the assets at the disposal of the DHS, FBI, and DOJ, hunt all the guests down and imprison them.  We can’t sleep safely until all those terrorists are securely shackled.

Virginia “Ginni” Thomas, the wife of Supreme Court Justice Clarence Thomas, emailed with Trump campaign lawyer John Eastman in correspondence obtained by the House select committee investigating the Jan. 6, 2021, attack on the Capitol, The Washington Post reported Wednesday.

Citing three people involved in the committee’s investigation, the Post reported the emails’ existence while saying its sources declined to provide further details about the communications.

Eastman, a conservative law professor, crafted two memos for the Trump campaign in the lead up to Jan. 6 outlining a strategy to block certifying the election results.

Trump and Eastman’s efforts to pressure then-Vice President Mike Pence to not certify the Electoral College votes are expected to be a central focus of the committee’s hearing on Thursday afternoon.

 

Ginni Thomas’s attempts to overturn the election results have drawn fierce criticism from Democrats. The Post reported on Friday that Thomas emailed 29 Arizona state lawmakers to help reverse President Biden’s win in the state.

Thomas’s involvement in the efforts has raised ethical questions over her husband’s role in deciding cases related to the election and Jan. 6. Justice Thomas has argued his decisions are entirely separate from his wife’s activism.

The Hill has reached out to the Supreme Court and Ginni Thomas for comment.

A federal judge last week ordered Eastman to turn over another batch of 159 documents subpoenaed by the panel. The same judge in March previously ordered Eastman to turn over documents to the committee.

Eastman had cited attorney-client privilege as reason for keeping the documents from the committee, but the judge invoked the crime-fraud exception, which forfeits protection from disclosure if an attorney “more likely than not” aided in a criminal or fraudulent enterprise.
