Former President Donald Trump told a talk show host on Thursday that even if he is criminally indicted he would have "no prohibition" against running for president again in 2024.

I can't imagine being indicted I have done nothing wrong," Trump said on the Hugh Hewitt Show. "I think you'd have problems in this country the likes of which you have ever seen before."

Hewitt, who is a conservative radio host, then asked Trump, "What kind of problems?"

The former president responded: "Big problems."

Trump faces numerous criminal investigations and lawsuits stemming from the January 6 insurrection and his efforts to overturn the 2020 presidential election results.

A person can run for office if they face criminal charges, and theoretically they could even run for office from prison — as that is not barred by the Constitution.

Hewitt asked Trump if he was insinuating the possibility of violence if the former president was indicted.

"That's not inciting," Trump replied.

Former President Donald Trump warned on Thursday that if he is criminally indicted, there would be "big problems," an allusion to street violence that the ex-president didn't reject.

In an interview with conservative radio host Hugh Hewitt, Trump said of a potential indictment, "I don't think the people of the United States would stand for it."

 

He added: "I think you'd have problems in this country the likes of which perhaps, we've never seen before."

Trump's remarks come over a month after federal authorities conducted a search at his Mar-a-Lago estate as part of its investigation into his handling of government documents — over 100 documents recovered were marked as classified.

Following the news of the FBI search at his Florida residence, there were renewed calls among conservative groups and his supporters for a civil war in the country. In the charged atmosphere, Trump had warned that the country is "in a dangerous position" and that Americans "are not going to stand for another scam," rhetoric that simultaneously feeds the anger of his supporters and normalizes the possibility of violence without explicitly urging it.

In the Thursday radio interview, Hewitt broached the possibility his comments could be taken as condoning violence.

Trump replied: "That's not inciting. I'm just saying my opinions. I don't think the people of this would stand for it."

Senate Judiciary Chairman Richard Durbin, an Illinois Democrat, denounced the former president's latest remarks on Thursday saying that they are "careless" and added that "inflammatory rhetoric has its consequences."

Political scientists have warned that the US could see violence similar to the January 6, 2021 assault on the US Capitol that left seven dead and more than 140 police officers injured.

"When you have politicians who are riling everyone up and law enforcement that is sort of wishy-washy or weak in its response, then I think you have a really volatile mix that emboldens these kinds of groups to continue with what they're doing,"Carole Emberton, a history professor at the University at Buffalo who specializes in the American Civil War, said in a previous interview with Insider.

The Justice Department's probe into Trump's handling of government records comes against the backdrop of several other investigations involving the former president.

Fulton County District Attorney Fani Willis is conducting a criminal investigation into whether Trump and his associates attempted to interfere in Georgia's 2020 election results. New York Attorney General Letitia James is conducting a civil investigation of the Trump Organization and its business practices. And a House select committee is investigating Trump's role in the US Capitol attack.

Trump told Hewitt in the interview that he did not do anything wrong and believes that the Justice Department will not indict him. He also added that an indictment against him is 'no prohibition' on him running for president in 2024.

Legal experts told Insider that technically Trump could run for president even if he is charged, convicted and put behind bars. The constitution only requires presidential candidates to be at least 35 years old and a natural born US citizen.

  • The confiscated devices could help agents track a person's communications and even movements.

Adding to the clues that the Justice Department is heating up its investigation of former President Donald Trump is the latest revelation that federal authorities have seized cell phone devices from two more of his close associates.

The cell phones seized by federal authorities were from Trump's campaign and legal adviser Boris Epshteyn and Republican campaign operative Mike Roman. The New York Times also reported that the Justice Department issued about 40 subpoenas to other individuals for its investigation into the fake slate of electors scheme.

Under current laws, federal authorities cannot seize cell phones without probable cause. These electronic devices could provide a lot of insight into an individual's activity and involvement, said David Weinstein, a former prosecutor and Miami criminal defense attorney.

"They can also use the information on the phone to track whereabouts and locations based on GPS functions that phones have," said Weinstein, referring to federal authorities. "It also helps law enforcement corroborate a lot of other evidence and testimony that they have."

Since the Justice Department began its investigation into the January 6 insurrection, federal authorities have seized phones and electronic devices from at least nine individuals in Trump's orbit.

Here's a look at who they are and how they could potentially be involved in the DOJ's investigation.

Rudy Giuliani

Former NYC Mayor Rudy Giuliani was Trump's personal attorney. Last April, federal authorities searched his home and seized 18 electronic devices, including his cell phone. Federal prosecutors said at the time that the devices belonged to Giuliani and "certain employees" of Giuliani Partners, according to the Associated Press.

Following the search, Giuliani's attorneys said that federal agents treated their client like a "drug kingpin" rather than a personal attorney to the former president.

In the aftermath of the 2020 presidential election, Giuliani peddled election fraud conspiracy theories and pursued legal strategies to overturn the election results.

Toensing is a former federal prosecutor and close ally of Giuliani and Trump. Last April, federal authorities also executed a search warrant at her home and seized her electronic devices. Prosecutors said the government obtained a warrant to search for a device "for evidence of enumerated offenses." The devices were later transported to the Southern District of New York, according to the Justice Department.

Toensing did not respond to Insider's request to comment.

Last June, federal authorities served a search warrant on Nevada State Republican Party Chairman Michael McDonald and seized his phone.

The House select committee, which is also investigating the January 6 insurrection, has also issued a subpoena for him and 13 others to testify and turn over documents related to the fake elector scheme. That effort sought to name electors for Trump in states that now-President Joe Biden won in an apparent attempt to derail the congressional certification of Biden's victory.

McDonald did not respond to Insider's request to comment.

Pennsylvania Rep. Scott Perry

Scott Perry

In August, federal authorities seized Pennsylvania Republican Rep. Scott Perry's cell phone device while he was on vacation in New Jersey.

Perry then filed a lawsuit against the Justice Department, requesting for all the cell phone data to be returned to him. He also asked the judge to block federal authorities from reviewing his phone data.

Perry did not respond to Insider's request to comment.

John Eastman

John Eastman

Eastman is a conservative attorney who advised Trump that the then-Vice President Mike Pence could overturn the 2020 presidential election result, in direct conflict with Pence's advisers who warned this would be unlawful.

White House counsel Pat Cipollone testified before the House select committee investigating the January 6 insurrection and told the panel that he confronted Eastman over his theories to overturn the 2020 election results.

Jeffrey Clark

Clark was a DOJ assistant attorney general in the Trump administration. In June, federal authorities searched his home in Virginia and seized his electronic devices, which reportedly included his phone.

During their public hearings, the House select committee revealed that Clark, a former environmental lawyer, wrote up a letter claiming that there was election fraud during the 2020 presidential elections and was prepared to send it out to state legislatures in an attempt to overturn Biden's victory in those states.

Clark has previously criticized the Justice Department's investigation calling it "highly politicized."

He did not respond to the Insider's request to comment.

Epshteyn is a former campaign adviser to Trump who helps to coordinate the former president's legal strategy. Fulton County District Attorney Fani Willis filed a petition seeking Epshteyn to testify as a part of her probe into whether Trump and his associates attempted to overturn Georgia's 2020 election results. The January 6 committee has also subpoenaed him to testify in its investigation.

He did not respond to Insider's request to comment.

Mike Roman

Roman is a former election operations director for Trump's re-election campaign. The Hill reported that on January 6 he delivered lists of false election certificates to Republican Rep. Mike Kelly of Pennsylvania.

Lindell, the CEO of bedding manufacturer My Pillow, said federal authorities served him with a subpoena to obtain the contents of his phone. Lindell has peddled Trump's theories on voter fraud and faces a $1.3 billion defamation lawsuit from Dominion Voting Systems.

He did not respond to Insider's request at this time to comment on the matter.

Trump's Fumbling Rally For J.D. Vance Clashed With Big Ohio State Football Game

Ohioans were glued to their TV screens Saturday night during Donald Trump’s rally for Republican Senate candidate J.D. Vance. But they were far more likely to be watching a critical Ohio State football game rather than anything political.

The fumbling schedule for the rally was so very unfortunately held the very same time as an important Ohio State game against the University of Toledo (the Buckeyes won 49-21). That happened because Trump and Vance “apparently don’t know how Ohio works,” Mediaite quipped last week. The Columbus Dispatch reported last week that a record-breaking 10.5 million viewers tuned in to Ohio State’s game against the University of Notre Dame earlier this month.

No one was happier about the goof up than Democrat Tim Ryan, who’s running against hedge-fund founder Vance.

Ryan even made a campaign ad mocking it, turning the rally into another kind of football game — for losers.

Ryan’s conclusion: “J.D. Vance is playing Ohio.”

Trump touted Vance in his Youngstown speech. But he also spent much of the time complaining about several investigations into his own suspect activities, which he perceives as persecution. He also lamented — to music — the dark, apocalyptic chaos of current times as supporters gave him a raised arm, single finger “salute” that some described as a QAnon gesture.

The New York Times reported Friday that candidates Trump touts at his rallies are not all happy about it.

Mehmet Oz, the Republican candidate for Senate in Pennsylvania, suddenly appeared to distance himself from Trump once he won his primary to broaden his appeal for the general election. He did, however, dutifully attend Trump’s rally early this month in Pennsylvania.

Trump, in an apparent response to the Times story, insisted to the crowd in typically vulgar Trump-speak that Vance is “kissing my ass.”

He also claimed in a Truth Social post earlier in the day that “both J.D. Vance and Dr. Oz asked me to do big rallies for them.” He added: “Look at the massive crowds. Both candidates wanted this — and I delivered.”

But the Times reported that neither candidate asked him to hold the rallies.

Former President Trump’s favorability rating has dropped to a new low after slowly trickling down over the past few months.

A new NBC News poll released Sunday found that 34 percent of registered voters said they have a positive view of Trump, while 54 percent say they have a negative view of him. Trump’s favorability rating was at its lowest in April 2021, when his rating fell to 32 percent in the same NBC poll.

The former president’s favorability score is down slightly since last month, with the same 54 percent saying they have a negative view of Trump, but 36 percent saying they had a positive view of him.

While Trump’s favorability score has trickled down, President Biden’s score has gone up, though only slightly. This month, 45 percent said they approve of the president — a 2-point increase since last month.

 

Contrarily, 52 percent of voters say they disapprove of Biden, which has gone down 3 percentage points since last month.

Pollsters also questioned voters about their views on the different investigations against Trump, specifically asking whether the various investigations should stop or continue. The poll found that 56 percent of voters believe the investigations should continue, while 41 percent say they should stop.

The poll comes amid an FBI investigation into Trump and the documents he was holding at Mar-a-Lago. The government recovered thousands of government documents from the Florida property since Trump left office, including more than 300 documents with various classified markings.

The NBC News poll surveyed 1,000 registered voters between Sept. 9-13, and has a margin of error of 3.1 percentage points.

While campaigning for Republican U.S. Senate candidate J.D. Vance Saturday, former President Donald Trump mocked him, telling a rally in Ohio that Vance was trying to get into his good graces.

"J.D. is kissing my ass. Of course, he wants my support," Trump said.

“The entire MAGA movement is for J.D. Vance,” he added.

Trump said that Vance fell in love with him the same way North Korean leader Kim Jong Un did.

"This is a great person who I've really gotten to know," Trump said of Vance. "Yeah, he said some bad things about me, but that was before he knew me and then he fell in love. Remember, I said that about Kim Jong Un – he fell in love, and they said, 'Oh, Trump was saying he fell in love.' Actually, he did."

He told the crowd that the choice in November is between voting for Democrats — assuring the continued “destruction” of America — or voting for Republicans in order to save the country.

I’m pretty much done watching the news…fox, cnn etc….too biased on all accounts. Not worth my time. Being levelheaded you can’t think that Biden who can barely string a sentence together and hid in his basement the entire election could have won based on all the accomplishments that Trump has made in his four years. It’s common sense. There’s no way sleepy Joe one. The guy is a half a step away from dementia and you think most of America wants him running the country…not Fox News…just common sense.  Biden is a puppet…if you can’t see that then you are also a puppet.  Dems love folks like you!
