⚖️ Oped by @SOCIALDAMUS  | Whether accusations are true or false, the process of convicting someone of a crime begins with calling the police, so that the police can investigate and document evidence to be used in court.

If you have a trial in which these initial steps have not been taken, then you have no basis to prosecute because legally your claims are only accusations with no documented proof. 

 

 A judge would understand this and be bound to throw out a case that has not been established based on following that procedure. 

However, when you rely on a jury, you are relying on people who have no legal education whatsoever to properly assess a legal matter. - so I ask you " would you put your life in the hands of the average joe off the street to perform heart surgery on you " ? 

Well, relying on a jury is the same principal, you are asking someone who is not qualified - to act as if they are qualified. - so no matter how you wish to look at it, when a jury is used you are actually removing the law from the equation - which opens the door for misunderstandings and even false accusations to be judged with the same credibility as proven legal facts.
