The panel of three judges, all appointed by Republican presidents, upheld Brann's ruling to dismiss the lawsuit for lack of evidence. Judge Bibas wrote that "calling an election unfair does not make it so. Charges require specific allegations and then proof. We have neither." Trump lawyer Jenna Ellis responded by saying that "the activist judicial machinery in [PA] continues to cover up the allegations of massive fraud." Trump's legal team have few options left. They can ask the Supreme Court for emergency injunctive relief.
