During Four-Hour Deposition, Trump Answered Only One Question

The New York State attorney general, Letitia James, sat across from Donald J. Trump as he repeatedly declined to answer questions, invoking his right against self-incrimination during a deposition on Wednesday, according to one of Mr. Trump’s lawyers.

The lawyer, Ronald P. Fischetti, said that over the course of about four hours, with several breaks, Mr. Trump answered only one question, about his name, toward the beginning of the interview.

Then he read a statement into the record in which he called the inquiry a continuation of “the greatest witch hunt in the history of our country” and accused Ms. James of having “openly campaigned on a policy of destroying me.”

Ms. James did not visibly react, Mr. Fischetti said.

After that, Mr. Trump repeated the words “same answer” from about 9:30 a.m. to around 3 p.m., with a long break for lunch and several shorter breaks.

“They asked a lot of questions about valuations and golf clubs and all that stuff,” Mr. Fischetti said. He said that Mr. Trump did not diverge from that answer, offering the same response until the interview was over.

 

Ms. James read an introduction at the opening of the interview but left the questioning to one of her office’s lawyers, Kevin Wallace. A number of other lawyers from her office were present, and Mr. Fischetti said he was joined by another of Mr. Trump’s attorneys, Alina Habba.

The attorney general’s office had not been alerted in advance that Mr. Trump was going to take the fifth, Mr. Fischetti said, in part because the decision was made only shortly before the interview and Mr. Trump had to be persuaded not to answer the questions substantively.

“He absolutely wanted to testify, and it took some very strong persuasion by me and some others to convince him,” Mr. Fischetti said.

The statement that Mr. Trump read overlapped significantly with one that he released publicly earlier in the day, in which he linked his refusal to answer questions to the F.B.I.’s search of his home on Monday, casting the actions as part of a larger effort by his political opponents to discredit him. (The two investigations are not linked.)

“I once asked, ‘If you’re innocent, why are you taking the Fifth Amendment?’” he said in both statements. “Now I know the answer to that question.” He said that he was being targeted by lawyers, prosecutors and the news media, and that left him with “no choice.”

A search warrant newly unsealed on Friday reveals that the FBI is investigating Donald Trump for a potential violation of the Espionage Act and removed classified documents from the former president’s Florida estate earlier this week.

A receipt accompanying the search warrant, viewed by POLITICO in advance of its unsealing, shows that Trump possessed documents including a handwritten note; documents marked with “TS/SCI,” which indicates one of the highest levels of government classification; and another item labeled “Info re: President of France.”

Also among the items taken from Mar-a-Lago this week: An item labeled “Executive grant of clemency re: Roger Jason Stone, Jr.,” a reference to one of Trump’s closest confidants who received a pardon in late 2020.

The warrant shows federal law enforcement was investigating Trump for removal or destruction of records, obstruction of justice and violating the Espionage Act — which can encompass crimes beyond spying, such as the refusal to return national security documents upon request. Conviction under the statutes can result in imprisonment or fines.

 

The documents, unsealed after the Justice Department sought their public disclosure amid relentless attacks by Trump and his GOP allies, underscore the extraordinary national security threat that federal investigators believed the missing documents presented. The concern grew so acute that Attorney General Merrick Garland approved the unprecedented search of Trump’s estate last week.

The disclosure of the documents comes four days after Trump publicly confirmed the court-authorized search of his Mar-a-Lago home by the FBI, marshaling his political allies to unleash fierce criticism of federal investigators. But the details in the warrant underscore the gravity of the probe — an unprecedented investigation of a former president for mishandling some of the nation’s most sensitive secrets.

Trump has claimed since Monday that he has cooperated with investigators from the National Archives and FBI for months and that the unannounced search was an unnecessary escalation. But after several rounds of negotiations in which materials were recovered by the Archives, federal investigators came to believe Trump hadn’t returned everything in his possession.

The search warrant, signed on Aug. 5 by federal magistrate judge Bruce Reinhart, revealed that dozens of items were seized, most of them described in vague terms like “leatherbound box of documents,” “binder of photos” and “handwritten note.”

Other items on the list indicate the presence of classified material, describing them as “miscellaneous top secret documents” and “miscellaneous confidential documents.”

Stone's attorney Grant Smith said that the longtime Trump ally "has no knowledge as to the facts surrounding his clemency documents appearing on the inventory of items seized from former President Trump’s home at Mar-a-Lago."

Shortly after 3 p.m., the Justice Department confirmed that Trump’s lawyers would not oppose the public release of the search warrant and underlying receipt of materials, which had already begun to circulate widely.

Donald Trump’s allies are suddenly not quite so eager to defend him and attack the FBI over agents’ search of the former president’s Mar-a-Lago home amid new reports about what might have been found and possible charges he could face.

“As people around him have learned more details about the extent of what he was keeping there, and the various efforts behind the scenes to get them, short of a search warrant, alarm has grown in recent days when you talk to advisers of the former president,” Washington Post reporter Josh Dawsey said Friday on MSNBC. “Some of them are starting to go dark and to stay as far away from this as they can.”

Dawsey said even some of those close to the former president may have no idea what kind of documents he was keeping, indicating they may be startled by what they’re now learning.

FBI agents on Monday removed 20 boxes of documents, including 11 sets of classified information, from Trump’s Mar-a-Lago estate and resort in Florida, according to the warrant and property receipt used by the FBI to conduct the search. The documents were unsealed by a federal magistrate judge Friday at the request of U.S. Attorney General Merrick Garland.

Some of the seized classified information was highly sensitive and top secret, designated to remain only in a secure government facility. Sources told The Washington Post in a report Thursday that some of the classified documents were believed to be related to nuclear weapons, which was a key reason for the urgent search.

The warrant indicated that Trump is under investigation for a possible violation of the Espionage Act, obstruction of justice, and removing and destroying official documents. No specifics were provided in the documents.

The Espionage Act prohibits anyone from obtaining defense information with the possible intent of using it against the U.S. or to further the interests of a foreign country.

After the search, several right-wing extremists erupted online, posting calls for a civil war and for Americans to “lock and load” after Trump and a number of Republican lawmakers used incendiary language to disparage the FBI and the Department of Justice.

Trump has called the legal search a “raid,” a “siege,” “lawless” and “corrupt.”

House Minority Whip Steve Scalise (R-La.) claimed, without any evidence, on Thursday that the FBI agents executing the search warrant went “rogue,” and Rep. Paul Gosar (R-Ariz.) said it was time to “destroy the FBI.”

Though several Trump allies appear to be “going dark,” Dawsey predicted that others will continue to speak out on the former president’s behalf, citing their faith in his “Houdini-like” ability to escape accountability.
